THIS IS A LEGAL AGREEMENT BETWEEN YOU, THE END USER, AND Search
Fit Shopping Cart Solution. IF YOU DO NOT AGREE TO THE
TERMS OF THIS AGREEMENT, DO NOT DOWNLOAD OR USE THIS SOFTWARE.
COPYRIGHT
The software is not open source or freeware. The Search
Fit software (software) is protected by the copyright
laws and by international treaty provisions. You may not distribute
the software or any parts of it - the software shall be available
only at www.searchfit.com.
LICENSE
An unlicensed copy of the software may be used only for the sole
purpose of testing the software. An unlicensed copy of the software
may not be used in real world for selling or representing products
or services. Web designers and internet service providers may install
an unlicensed copy of the software at their web site for the sole
purpose of demonstrating the software. In this case, it must be
clearly stated that the software is Search Fit
Shopping Cart Solution Software.
A licensed copy of the software may be used for an limited or unlimited
amount of products and users with monthly fees. The minimum contract
time per license is 12 months. For each installed instance of the
software, a separate license is required.
The software is licensed for non-exclusive and transferrable use.
The ownership of the software remains with Search Fit .
You may resell or transfer the software licenses issued to you by
SearchFit.us.com to a 3rd party. The receiving party of the license
must agree to the terms of this software license agreement and be
aware that the software license is issued to you by Search
Fit .
SOFTWARE MODIFICATIONS
You may modify the source code of the software, but you may not
modify the documentation or remove any copyright notices. Modified
code of the software is still the intellectual property of Search
Fit .
WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY
The software and the accompanying files, or the special editions
of the software, are provided "as is" and without any warranties
expressed or implied. In no event shall Search Fit
be liable for any damages whatsoever (including, without limitation,
lost profits, business interruption or lost information) resulting
from the use of or inability to use the software.
GENERAL
Search Fit does not sell, share or rent any customer information
to others. When you supply information about you for a specific
purpose, the information will be used for that purpose only.
Failure to comply with this license agreement will result in immediate
termination of your license without refund. You will also be held
responsible for any loss in business caused to Search Fit
. This license will be governed by and construed in accordance
with the laws of United States of America.
